GENERAL TERMS AND CONDITIONS OF TENDER / SALE

  1. ACCEPTANCE

For bespoke and quoted works, any offer is only binding upon us for 60 days and is subject to fluctuations in currency exchange rates and basic raw material prices. Orders for quantities larger or smaller than those quoted may require revision of the unit price. Any drawings, descriptions, models, samples and the like that are submitted free of charge in connection with an offer shall remain our property, shall not be misused or transferred to a third party and must be returned to us if our offer is not accepted.

For e-commerce, once your order has been placed, the warranty is subject to product supplier’s warranty. If there is an issue with the product, The Metal Supply Shop will accept the return and deal with the supplier to ensure that a satisfactory resolution is reached. 

For metal that is custom cut, once the order has been placed, the size cannot be altered in any way and will not be refunded (unless there is an error on the part of The Metal Supply Shop). 

  1. PRICE

Quotations are issued in good faith, based on information available at the time of tendering. Prices tendered are subject to change during final technical review; also due to unforeseen circumstances such as unplanned changes to acceptance criteria, work stoppages on site, etc. Prices quoted are NETT of VAT unless specified otherwise.

Prices on the website that are available to purchase live on the site, are not subject to change. Prices of metal etc will be updated by the Company as and when this happens but will be bought at the prices listed on the website. 

If you are purchasing a custom cut piece of metal, it will be priced accordingly and is not subject to change. 

All website sales are inclusive of VAT. 

  1. TECHNICAL REVIEW & DESIGN RESPONSIBILITY

All products will be cut (if required), packaged and dispatched at the earliest convenience of the Company. The goal will be, subject to availability, to have all dispatched within 2 weeks of orders being processed. 

Once an order has been placed, it cannot be edited or changed, as it is custom cut bespoke to each order. If there is an error on the behalf of the company, we will ensure to have this corrected at the earliest convenience. If there is a problem with any of the products sent, they will be subject to the warranty provided by their manufacturer. We will process returns based on these details on a case-by-case basis. 

  1. DELIVERY & DEFECTS

Goods are in all cases sent at the purchaser’s risk, regardless of whether the purchaser or the vendor has paid the cost of carriage. Claims relating to faults or deficiencies in execution of an order must be made within 10 working days following receipt of the goods. 

Goods can only be accepted for return in undamaged condition and subject to prior agreement. Goods cannot be accepted as returns where they have been custom cut for an order. 

Where it is established that The Metal Supply Shop and its staff have failed to execute specified work instructions, we must be afforded every reasonable opportunity to investigate the cause of the failure and to carry out remedial actions.

  1. FORCE MAJEURE / ERRORS

We reserve the right to exception from the liability for force majeure of any nature when they occur after an agreement is entered into and entails delayed delivery or impedes fulfilment of the agreement.

If we have incorrectly listed a product, that is no longer available, we reserve the right to change or amend the product listing, even if the order has gone through. We will of course, contact you to let you know of alternative options or to process a refund.

  1. LAW

The contract shall be governed by the Law of Ireland. Any dispute arising out of this contract shall be subject to the exclusive jurisdiction of the Courts of Ireland.

  1. PAYMENT TERMS & RETENTION OF TITLE

All orders processed on our website are subject to payments being made on our website via PayPal, debit or credit cards online. Once an order has been placed and payment has been received, we will begin to process your order – aiming to have the product dispatched within 2 weeks. 

Once your bespoke order has been processed, it cannot be amended. We also ask you confirm your postal address has been inputted correctly as we will not be liable for incorrect delivery details.
